Non-harassment order

This is a court order which states that your partner/ex-partner cannot commit certain actions (for example following you, repeatedly texting you or other actions which frighten or distress you).

If your partner/ex-partner has been convicted of an offence against you, the sheriff may impose a non-harassment order along with the sentence. You can also apply to the court for a non-harassment order through a solicitor. You must show that on at least two occasions your partner/ex-partner put you in a state of alarm or distress.

If your partner breaks a non-harassment order

If your partner/ex-partner breaks the conditions of the order, he may face court action and a fine or imprisonment.

If your partner/ex-partner breaks the order you should contact the police and tell them what he has done. You should also tell them that you have a non-harassment order. The police can arrest your partner without a warrant. They will send a report to the Procurator Fiscal and your partner will need to go back to court.
